These terms govern your use of Adaptive Selling, provided by DIGITAL SMILE COMPANY LIMITED (CÔNG TY TNHH NỤ CƯỜI SỐ), tax code 0109224865, No. 4, Lane 151B Thai Ha Street, Lang Ha Ward, Dong Da District, Hanoi, Vietnam. By creating an account or using the service you agree to them on behalf of yourself and the business you represent.

  1. 1. The service

    Adaptive Selling is a shared inbox that shows messages customers send to your Facebook Pages and lets your staff reply to them through Messenger. Features may change as we improve the service.

  2. 2. Accounts

    • You must provide accurate information and keep your password confidential.
    • The account owner is responsible for the staff accounts they create and for everything done through them.
    • You may only connect Facebook Pages that you are authorised to manage.

  3. 3. Plans and Page limits

    Each business account can connect a number of Pages set by its plan or licence key. Paid plans, prices and billing terms are agreed with you in writing or shown at purchase. We may suspend accounts that remain unpaid after notice.

  4. 4. Acceptable use

    When you use Adaptive Selling you must follow Meta's Platform Terms, Messenger Platform policies and applicable law. In particular you must not:

    • Send spam, promotional or bulk messages, or message people who have not contacted your Page.
    • Reply outside the messaging window Messenger allows.
    • Use the service for unlawful, deceptive or harmful content, or to collect sensitive data you have no right to process.
    • Try to access other businesses' data, overload the service or reverse-engineer it.

  5. 5. Your data

    You keep all rights to your content and your customers' messages. You give us permission to process them only to provide the service, as described in the Privacy Policy. You are responsible for having a lawful basis to handle your customers' messages and for answering their requests about their data.

  6. 6. Availability

    We work to keep the service available and secure but do not guarantee it will be uninterrupted. Delivery of messages depends on Meta's platform, which we do not control.

  7. 7. Suspension and termination

    You can stop using the service and delete your data at any time. We may suspend or close an account that breaks these terms or Meta's policies, or when Meta restricts access to its platform. After termination, data is deleted as described in the Privacy Policy.

  8. 8. Liability

    To the extent permitted by law, the service is provided as is, and we are not liable for indirect or consequential losses, lost profits or lost data. Our total liability for any claim is limited to the fees you paid us in the three months before the claim.

  9. 9. Governing law

    These terms are governed by the laws of Vietnam. Disputes are settled first by negotiation, then by a competent court in Hanoi.
